Provided Documentation

All documentation created and provided to client is owned and copy written by Consultant and cannot be used or given to any other 3rd party.


Liability

It is understood that Consultant is only liable for services completed and provided by Consultant and cannot be held liable for the services of other contracted vendors. It is understood that in no event shall Consultant be liable for consequential damages of any kind.

All customized items are non refundable, cancellable, or transferable. 

By completing your payment you agree and adhere to a one time charge of the agreed amount. 

Once payment is complete you will not be able to add/change your order without a reflection of a new invoice. Once a new invoice is sent payment must be made to update changes. 


Service

Cancellation Policy

If service is canceled, no portion of the fees paid to Consultant will be returned. If service is canceled less than 6 months before date, 2nd payment will be required to compensate for hours of service already rendered and loss of service date. If the service is postponed, services contracted can be applied to a new date if available (refer to Postponement Policy). In the event of cancellation, payment will not be refunded but transferable for a different day. 

 

If event is cancelled by consultant for any reason not due failed contractual terms, a third party consultant will be provided. If cancellation terms can not be mutually met, a percentage of payment can be refunded to client per consultants discretion. Not all outcomes will be favorable, this will be case by case scenario.


Working Conditions

The Client(s) expressly agree(s) to take best efforts to provide [TBL] and TBL's staff with safe and appropriate working conditions. In the event of circumstances deemed by either [TBL] or a bystander to present a threat or implied threat of injury or harm to [TBL] staff or equipment, the [TBL] reserves the right to cancel all services remaining under this Agreement and leave the event. At the [TBL]’s discretion, the [TBL] may enact a three-strike policy. After the first offense, the [TBL] will make reasonable efforts to notify the Client(s) or a responsible party. If the Client(s) is/are able to respond to the threatening situation in a reasonable amount of time (maximum of 15 minutes), [Provider] shall resume work in accordance with the original terms of this Agreement. If the threatening behavior occurs for a second time, the Client(s) will agree to remove the offending person for the remainder of the event. If the behavior occurs a third time, the [TBL] will immediately leave the event. If the [TBL] leaves the event early due to any offending behavior, the Client(s) expressly agree to relieve and hold [TBL] harmless as a result of incomplete event coverage, or for a lapse in the quality of the [TBL] work, and the Client(s) shall be responsible for payment in full.


Postponement Policy

If service is postponed, all services will cease at time of notification of postponement if no determined new date is provided. Payment schedule will be determined and readjusted post new event date notification. If client requires services to resume, post new event date being established, all payments will be required at time of service re-start. We require to be notified at least 72 hours in advanced minimum of any event changes such as location, time of start, arrival , delay and any other specifications that require adjustments to ensure fulfillment of contractual obligations. Failure to notify consultant in timely manner can result in withdrawal of full or most services, event cancellation by consultant, or companies right to make their own adjustments as it fits business needs with or without client approval. 

 

Professional(s) will arrive promptly before event time for setup and will return on or before the event is complete to retrieve items such personal equipment, backdrop stands, and any other items used by company to decorate event. By also completing payment you agree to cover cost of damages , if any, of equipment used at your event.

For Hotel/Airbnb/ Home decor you have 3 business days after payment is submitted to cancel service. Non refundable Retainer to secure service date and time is 50% of total cost.


Consultant is not responsible for Acts Of God, Natural Disasters, an Act Of Government such as A Declaration of National or Local Emergency, or Other Incidents Not within the control of the consultant, i.e. accident, death in the family, illness, pregnancy, or sudden tragic circumstance. In such a situation, consultant will obtain, upon approval of the client, a qualified professional replacement to fulfill consultant’s obligations under the contract, at no additional charge to the client.


Printing Service

Proofs for custom items are included with purchase. Expected wait time is 1-3 business days added to turnaround. Your proof will be sent for your approval. If there aren’t any changes to made we will proceed to print.

COPYRIGHT PROTECTION


Emeraldz Photography and Designz, LLC. & Thee Balloon Lady owns all copyrights to each original design. All designs are copyrighted once created. Design team will send proof , but Ownership is not transferred once payment is complete. Separate design contractual invoice will be issued if the owner wants to use any of our designs for further use. (eg, printing by a different company, graphic designer, etc. ) 


If designs are used by another company, graphic designer, different personnel it is considered copyright infringement. 


 We will not duplicate, imitate or print work from other companies and designers. Please read our policy before submitting payment. Once payment is submitted we reserve the right to acknowledge by completing payment that you understand and agree with these terms,
